pre-qualification of firms for a particular project, followed by invitation to tender for the contract

나. 입찰참가자격

발주자는 tender에 대해 어떤 qualification도 받아들여서는 안되며(Contracting Authorities should not accept any qualification to tenders), Bills of Quantities를 공개하여서도 안되며, 문제가 있는 tenderer에 대하여는 그 문제가 적절히 처리되기 전까지는 contracts를 award 할 수 없음


다. 입찰설명서 및 입찰참가요령

1) 입찰설명서

관보, 관련 web-site 등을 통해 입수

National Guidelines 상에 특별히 명시되어 있는 사항은 없음


2) 입찰참가요령(channels of supply)

０직접 참가

- 관보 등을 통해 입찰 정보를 입수, 입찰설명서 내용에 따라 직접참가 , agents 또는 distributor 이용

- 보건분야는 agents 또는 distributor를 가장 많이 이용하고 있으며 commercial State company는 가장 적게 이용

- 구매기능의 집중화(centralization) 수준이 높은 분야는 agents 또는 distributor 이용률이 적으며, 집중화(centralization) 수준이 낮은 분야는 agents 또는 distributor를 이용률이 높음

０하청(sub-contractor)으로 참가

- 외국기업에 대한 하청률은 5%-10%에 불가하여 상대적으로 불리


라. 입찰서 평가기준 및 평가절차

０평가기준은 입찰광고나 입찰서류에 명확히 제시되어야 하며 평가는 일반적으로 "best value for money" 원칙에 의해 이루어짐

- the lowest suitable tender : suitability는 capacity, organization, experience, performance on previous contracts, financial standing, compliance with any specifications or quality standards등을 의미

- the most economically advantageous tender : period for completion, maintenance costs, technical merit, cost effectiveness 등

가격은 일반적으로 Irish Pound로 표시되어야 함.


마. 계약의 이행

National Guidelines에 명시되어 있는 사항이 없어 EU의 관련 Directives를 따르고 있음.


바. 입찰 및 이행 보증금

1) 입찰 보증금

tender documents에 대한 deposit는 계약절차상 오랜 관행

deposit는 선의의 입찰참가자에게 신청후 즉각 철회하지 않는 경우 환불해 주어야함

deposit 금액은 관련 document 준비에 수반되는 marginal costs에 기초 과다하지 않아야 하며 marginal costs는 original set of tender documents 준비 비용을 포함하지 않음

fees 또는 deposits가 자유 경쟁에 장벽이 되어서는 안됨


2) 이행 보증금 : 특별히 규정하고 있는 사항 없음


사. 이의신청제도

National Guidelines에 명시되어 있는 사항이 없어 EU의 관련 Directives를 따르고 있음.
